The present conditions govern the sales of new products and
services by RVB-Photo at the http://eshop.cocardes.org website
Article 1 - Price
1.1 - The prices of our products are indicated in euros all inclusive
of tax (VAT + other possible taxes like taxes on the digital storage
mediums or ecological participation) except postage and packing
charges.
1.2 - In case of shipping outside of European Union and French overseas
territories (DOM-TOM), the price is calculated without tax as mentioned
on the invoice. Customs duties or other local taxes or importation laws
are under the buyer responsability. These rights do not concern the
RVB-Photo limited liability company. They are the responsibility of the
recipient and are of his whole responsibility. To be sure he is in law,
the buyer must get information near the qualified local services.
1.3 - The prices are revisable without notice but the price required is
that posted at the date of the order.
1.4 - The products remain the property of RVB-Photo until integral
paiement of the total price.
Article 2 - Order
2.1 - You can order at the website Eshop Cocardes. Contractual
information governing the orders is in French language, the
translations in other languages of these general terms of sales are
provided as an indication only.
2.2 - RVB-photo reserves the right to do not honour orders sent by
users of the site for which litigations took place.
2.3 - The purchaser is legaly able to buy. In the contrary case the
order will have to be actually realized by the parents or tutors of the
purchaser.
2.4 - In the case of payment by cheque or credit transfer, the order is
treated after receipt of the payment.
Article 3 - Availability
3.1 - The offers of the site are valid throughout all their posting on
the catalogue on line. Concerning the not stored products, the offers
are valid subject to availability in our suppliers. In all the cases,
the availability of a product is confirmed to you at the time of your
order and the indicative delays of delivery are communicated. Note that
information of availability and delays come from our suppliers, so we
cannot be responsible for the possible errors.
3.2 - In case of unavailability of an ordered and paid product, it will
be refunded either by PayPal in the case of purchase by this way or is
refunded by bank check or credit transfer within one month after
purchase.
Article 4 - Delivery
4.1 - The products are delivered to address mentioned in the order. The
products are transported by La Poste or private conveyor. The products
travel under the responsability of the recipient. In the case of
multiple orders RVB-Photo reserves the right to gather the sendings. In
the case of an order of several products, RVB-Photo reserves the right
to split shippings, in particular in case of different availabilities
of the ordered items.
4.2 - In the event of problem with the delivery you must issue reserves
and notify them to the conveyor and to RVB-Photo within 48 hour. An
exchange process or of refunding could then be launched if the
conditions evoked in article 5 are joined.
Article 5 - Retractation,
return of product
5.1 - The purchaser lays out a seven days deadline to cancel an order.
Cancellation of order must be made by mail with acknowledgement of
delivery sent to RVB-Photo terrestrial address or by fax. Placed this
time any order is firm and final.
5.2 - In the case of a delivery delay higher than 1 month thus not
previoused, an order can be cancelled by the purchaser.
5.3 - If an article would not correspond to expected (unconformity with
the description, non functional article), an exceptional return of the
goods can be carried out within seven working days. The return postage
charges are responsability of the purchaser and the returns are to be
carried out complete in their original state with the invoice. Any
deteriorated, dirtied, incomplete item will not be taken again nor not
refunded.
5.4 - The photographs, software, books, CD or DVD are not returned nor
not exchanged.
5.5 - To note that the returns in sending against-refunding are
systematically refused, for any reasons. 5.6 - The integral amount of
the order is then refunded according to the methods of refunding
specified in article 3.
Article 6 - Guarantee
Contractual guarantees of the manufacturers come with all the products
bought in RVB-Photo's and giving right to a guarantee. With exception
of the three points clarified in article 5, the products must be
returned to the manufacturer under responsability of the purchaser. The
addresses of the after-sales services of the manufacturers appear in
the technical documentation of the products. The invoice of the product
concerned will be required, thus take care to not loose it.
Article 7 -
Responsibility
The offered products are in conformity with the French legislation and
the applicable standards in France. RVB-Photo's responsibility cannot
not be committed in the event of non-observance of the legislation of
the country where the product is delivered. It belongs to you to check
near the local authorities the possibilities of importation or the use
of the products or services which you plan to order.
Article 8 - Justice
The present general terms of sale are subjected to the French law. The
court of Marseilles is qualified in the event of litigation.
